Agreement and Definitions

These Terms & Conditions (“Agreement”) govern your use of the Jugno vehicle telematics and fleet management platform (the “Service”) provided by Racketail Solutions and Technologies Pvt Ltd (“Racketail”, “we” or “us”) via the website www.jugno.biz. These terms apply when you (the “Customer”) place an order, register, or access/use the Service.

  • Scope & Precedence

In case of conflict between these Terms and any Customer‑issued purchase order, these Terms prevail. No modification is binding unless agreed in writing by an authorized representative of Racketail

  • Service Delivery

Racketail provides Jugno as a cloud-based software-as-a-service platform with optional hardware components (e.g., GPS devices, telematics units). Availability, functionality, uptime, and support levels are as specified in the Service Plan. We use commercially reasonable efforts to store data and maintain continuity of Service .

  • Customer Responsibilities

The Customer shall:

  • Ensure devices and vehicles are properly maintained and installed.
  • Pay all fees in accordance with billing terms.
  • Use the Service only for authorized business purposes and comply with all operational guidelines
  • Data Ownership & Usage

You retain ownership of all telematics data collected through Jugno. By using the Service, you grant Racketail a global, perpetual license to process, analyze, and use the data to provide and improve the Service. Racketail may share data with affiliates or authorized third parties, subject to confidentiality

  • Confidentiality

Both parties agree to safeguard confidential information, limit disclosure to necessary personnel, and use such information only for purposes defined herein. Confidential information must be
returned or destroyed upon termination

  • Limitation of Liability & Warranties

The Jugno Service is provided “as is” without express or implied warranties. Racketail is not
liable for indirect, incidental, or consequential damages arising from use of the Service. The Customer acknowledges that telematics transmissions may be subject to technical limitations.

  • Fees and Termination

Fees and billing terms are defined in the Service Plan or Order Form. Racketail reserves the right to amend fees or terms on notice. Termination fees or cancellation liabilities may apply if you terminate before the end of the committed term.

  • Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. Disputes arising hereunder will be subject to jurisdiction in applicable Indian courts.

10. Amendments

Racketail may amend these Terms from time to time by posting the revised version on www.jugno.biz. Continued use of the Service indicates your acceptance of
the amended Terms.
